Airbnb in Chiang Mai: Is Renting Your Condo by the Night Actually Legal?

Can you rent out a Chiang Mai condo on Airbnb?

In our experience, the safe answer is no for nightly lets in a Chiang Mai condo. Daily and weekly stays need a hotel licence, and the building adds its own rules on top. Many owners find that letting by the month is legal, steadier and far easier to explain to a buyer, a lender or a juristic person.

Picture a bright one-bedroom condo, a tidy balcony, and a seller who says, “You can put this on Airbnb tomorrow.” It sounds like income that is ready to switch on. Before you picture the first booking, there is one question worth asking, and it is not about the view: may I see the licence?

No. Renting a Chiang Mai condo by the day or week without a hotel licence breaks the Hotel Act, and condominium rules add further limits. Lets of 30 days or more fall outside the ban. Reform bills are still in committee and are not law.

What does Thai law actually say about daily and weekly lets?

Under the Hotel Act B.E. 2547 (2004), offering temporary accommodation for payment without a hotel licence is an offence, and daily or weekly lets of condo units are treated as exactly that. Lets of 30 days or more are not treated as hotel operation.

The Hotel Act was written long before holiday-rental platforms existed, but it has been applied to them. In two first-instance cases reported in 2018, condo owners in Hua Hin who let rooms by the day and by the week were found guilty of running an unlicensed hotel. The fines were small and neither owner was jailed. The reporting made the point that only lets of a month or longer sit outside the rule, which is why we base every return we discuss on monthly lets.

Why does a condo building add a second layer of rules?

Even with the Hotel Act set aside, a condominium is registered for residential use. A Department of Lands circular dated 6 November 2023 states that condo units cannot be used for hotel business, even with the agreement of the co-owners.

To run a hotel, the building owner would first have to cancel the building’s condominium registration and then meet the hotel, building-control and planning rules. That is a very different thing from a unit owner listing a flat on a booking platform. Reports also indicate that many juristic persons, the bodies that manage a condo building, have written daily-let bans into their house rules. An owner can therefore be on the wrong side of the building even where nobody from the authorities ever calls.

Does the 8-room, 30-guest rule make a single unit legal?

In our reading, no. A 2023 ministerial regulation raised the size at which accommodation counts as a hotel, but it does not remove the separate condominium position described above.

Ministerial Regulation No. 2 B.E. 2566 (2023), in force from 29 October 2023, treats accommodation with up to 8 rooms and no more than 30 guests as not a hotel. The earlier limit was 4 rooms and 20 guests. It is easy to read that as a green light for one flat. We read it differently, because the Department of Lands position on condo buildings stands on its own, and whether a particular owner could qualify for any exemption is a question for a Thai lawyer.

What are the real penalties, and how likely is enforcement?

The maximum under the Hotel Act is serious on paper, but the outcomes in the reported cases were modest and enforcement is described as inconsistent. We would still not build a purchase on the hope that nobody checks.

Penalties are only part of the picture. A buyer who needs the rent to cover a mortgage or running costs is exposed to a building ban, a complaint from a neighbour or a sudden crackdown, none of which shows up in a fine table.

What is the legal alternative: monthly lets?

Lets of 30 days or more fall outside the hotel rule, so a monthly or longer lease is the route we plan around. Many Chiang Mai condos are let this way to residents and long-stay visitors.

A written lease is the starting point. It fixes the term, the rent, the deposit and who pays the utilities. If the tenant is a foreign national, the host or owner still has to notify Immigration within 24 hours of arrival (the TM30 notice), so agree in the lease who does that, and check the current procedure with the Immigration Bureau. Rental income also has tax consequences, which we cover in our Thailand property tax guide. For tenants planning a long stay, our visa guide explains the main long-stay options.

How do I check whether a building can legally take nightly guests?

Ask for documents, not assurances. If the seller cannot show a hotel licence, treat the unit as monthly-let only.

Does the building or the unit operator hold a hotel licence?A copy showing the licensee name, licence number and dateOnly a platform listing, or “everyone does it here”
Is the building still registered as a condominium?Written confirmation from the juristic person or seller. A building must cancel its condominium registration before it can run as a hotel.Described as both a registered condominium and a licensed hotel, with nothing in writing
What do the building rules say about letting? The house rules and any letting policyRules ban daily lets, or the answer is verbal only
Is the unit in a rental pool or management programme? The management agreement, who holds the licence, and what happens if it lapsesA hotel-style name (condotel) but no licence document
What does the sale contract say about letting? The wording in the reservation agreement and sale contract, read by a Thai lawyerThe seller will not put any letting claim in writing
Who will report foreign guests to Immigration?A named person responsible within 24 hours of arrivalNobody can say

A hotel-style name, a furnished unit and a booking-platform profile are not evidence of a licence. Have a Thai lawyer confirm the documents before you pay a deposit. This post does not list buildings, because we cannot show from public sources that any condo building is permitted to take nightly guests, and we will not suggest that one is.

Proposal, not law. In July 2026 the House of Representatives accepted two Hotel Act amendment bills in principle and sent them to an extraordinary committee, which held its first meeting on 15 July 2026 with the Ministry of Tourism and Sports taking part. The aim reported is a registration framework for smaller operators. Committee review, further readings, the Senate, royal endorsement and publication in the Royal Gazette all remain, and no start date has been set. The circulating drafts differ, so we quote no thresholds. Even if a hotel-licence reform passes, one law firm notes that the Building Control Act would also need amending before residential units could be used as hotels, and the drafts do not address it. Until a new law is published, the 2004 Hotel Act applies.

Why does this matter for buyers in 2026?

Because some listings still describe a unit as Airbnb-ready, and reform headlines can make a proposal sound like a change in the law. Neither tells you whether the unit can legally take nightly guests today.

Sellers know that income sells property, and a nightly-let story is the easiest one to tell. In our experience the safer conversation is about monthly rent that the law and the building both allow. We treat any nightly income as unproven. Insider Tip

Ask for the hotel licence and the building’s letting rules in writing before you treat any unit as a nightly-let asset. If the seller cannot show a licence document, price and plan the purchase as a monthly-let unit only, and ask a Thai lawyer to read the sale contract before you pay a deposit.

The Hotel Act sets a maximum of one year in prison, a fine of up to 20,000 THB, or both, plus up to 10,000 THB for each day the breach continues. Enforcement has been described as inconsistent, but we would not build a purchase decision on that.

Yes. Lets of a month or longer fall outside the daily and weekly hotel rule, and many Chiang Mai condos are let this way to residents and long-stay visitors.
